In accordance with Article 2 of the statutes of the association :

« L’association a pour objet la sauvegarde d’œuvres peintes en péril présentant un intérêt public et historique. Après restauration, ces œuvres doivent être exposées dans un environnement les rendant visibles du public.
Sont concernées uniquement des œuvres peintes nécessitant des travaux de conservation et de restauration que les propriétaires ne peuvent financer.
Quelques soient les œuvres restaurées, l‘association s’appuie sur des valeurs laïques et sur une ouverture culturelle à tous les publics.
Pour cela, l’association recherche des fonds afin de financer les travaux de conservation et de restauration des œuvres choisies et s’assure que les donateurs portent les mêmes valeurs que les siennes.
L’association, pour réaliser son objet, se dote de tous les moyens légaux, logistiques, techniques et administratifs et développe des relations partenariales fortes avec les institutions publiques et d’autres partenaires associatifs et coopératifs. »

” The object of the association is the safeguarding of endangered painted works of public and historical interest. After restoration, these works must be exhibited in an environment that makes them visible to the public.
Are concerned only painted works requiring conservation and restoration that the owners cannot finance.
Whatever the restored works are, the association is based on secular values and a cultural openness to all audiences.
For this, the association is looking for funds to finance conservation and restoration of selected works and ensures that donors carry the same values as theirs. The association, to achieve its object, acquires all the legal, logistical, technical and administrative means and develops strong partnership relations with public institutions and others associative and cooperative partners. “

The association is thus entitled to receive donations and makes available to the public access to the helloasso online donation service for a secure payment by credit card, as well as a paper form to download and return by post for payment by check or cash.

ARTICLE 1 - Definitions

  • Member : Any natural or legal person who has joined the association and paid an annual membership fee
  • Donation : Financial payment made online or via the paper form to support the Muses & A.R.T. association or one of its projects.
  • Donor : User who has made a donation online or via the paper form.
  • Service provider : Professional of the Conservation-Restoration of Works of Art with which Muses & A.R.T. has concluded a partnership agreement with the aim of contributing to the realization of a heritage safeguarding project in accordance with the statutes of the Association.
  • Legal representative of the work : Owner or legal guardian, natural or legal person, of a work of art benefiting from a support by the association, with which Muses & A.r.T. has concluded a partnership agreement with the aim of contributing to the realization of a heritage safeguarding project in accordance with the statutes of the Association.
  • User : Any natural or legal person browsing the website of the association or using one of the communication tools made available to the User by the association (Brochure, Flyer, paper form, HelloAsso …).

ARTICLE 2 - Object

The purpose of these Terms and Conditions or T&Cs is to define the terms and conditions of online donations or by paper form proposed by Muses &A.R.T. and their use by the User, as well as various terms and conditions relating to the association’s website and the rights of the various parties.

The User must therefore carefully read these T&Cs and understand them. By accepting them, they acknowledge having read them and undertakes to respect their terms and conditions.

The association reserves the right to make changes to these T&Cs at any time. It is therefore up to the User to refer regularly to the latest version of the T&Cs permanently available on the association’s website.

In case of non-acceptance of these T&Cs, the User must renounce the donation online or by post.

In addition, each donor or online member via HelloAsso undertakes to respect the T&Cs of their service as defined by HelloAsso.

ARTICLE 4 - Members

To be a member, the natural or legal person must pay an annual individual contribution. The new member(s) tacitly accept by their membership these T&Cs (permanently available on the Association’s website), as well as the Statutes and the Rules of Procedure of the Association (available on request).

By becoming a member of the association, members are invited to receive the «Lettre des Muses» (biannual newsletter) by email and to participate in events organized throughout the year. During these events, photographs can be taken and published by the association in various media for communication or other purposes (website, newsletter…). If the member refuses to have their image reused, they can make the request directly during the event or by contacting the Association by email or mail.

ARTICLE 5 - Payment of the contribution or donation

To make an online donation, the User is invited to fill in the corresponding online form available on the dedicated pages on the website of the association or that of HelloAsso (www.helloasso.com/associations/muses-a-r-t). Secure payment is made by credit card via the secure payment platform by SSL encryption HelloAsso.

For payment by check or cash, the User is invited to return the duly completed paper form together with its payment to the postal address of the association. This form is available for download on the association’s website or on the association’s brochure distributed at events.

NB : When paying online via HelloAsso, the User is offered to make a donation to the Hello Asso payment platform but this is optional. It is sufficient for the User to indicate his choice before validation of the payment.

After making a donation online or by paper form, the User acquires the status of Donor.

The Donor becomes a Member of the association for the current calendar year as soon as they have made a donation equivalent to or greater than the amount of the annual membership fee.

ARTICLE 6 – Allocation of donations and contributions

The amounts of donations and contributions received are fully donated to Muses & A.R.T. for its own operation or for one of its projects to preserve painted works.

They are used in particular to reimburse the costs of insurance, communication and operation of the association, but also the costs relating to the care of the work to be restored (materials, travel, communication around the work, etc.).

NB : The conservation-restoration work is carried out by professionals, members of the association, on a voluntary basis.

ARTICLE 7 – Reallocation of donations

Clause only concerning donations dedicated to a specific project during fundraising campaigns.

The Donor agrees that their donation may be allocated to a project to safeguard painted works other than the one for which they made a donation, or to the operation of the Muses & A.R.T. Association, in the case of funds remaining at the end of the supported operation or if the operation did not succeed within two years after the start of the donation collection, or if the latter was inactive for a period of one year.

ARTICLE 8 - Protection of Personal Data Users

The collection of Users’ personal data is done in compliance with the General Data Protection Regulation (GDPR).

The association needs to collect personal information about Users for the proper management of its members and donors, and for the exclusive purposes of communicating information strictly relating to the object and actions of the association.

Access to the personal data collected is exclusively reserved for the various internal services of the association, including those responsible for data processing, the management of members and donors, and communication with the User.

The provision of data is mandatory unless otherwise stated. The data collected is kept for a period of two years.

The User agrees that the aforementioned personal data may be communicated to the secure payment platform HelloAsso (www.helloasso.com).

In accordance with the General Data Protection Regulation, the User has the right to access, rectify, delete and oppose their personal data. ARTICLE 9 – Intellectual Property: Copyright and Image Rights

   – Website

This website muses-et-art.org and each of the elements available on the said site (logos, images, texts, information, data and any other content), taken together or separately, are the exclusive property of Muses & A.R.T. and are protected by intellectual property law.

The rights of reproduction, representation or public communication are reserved, including for content that can be downloaded.

The User undertakes to request the prior and express authorization of the president of the Muses & A.R.T. association for any reproduction, publication or copy of any of these elements, on any medium whatsoever.

Any use for commercial or professional purposes is strictly prohibited.

   – Right to the image of the legal representative of the work

The legal representative of the work gives permission to Muses & A.R.T. as well as to the conservator-restorers to disseminate and exploit the images of the restorations of works carried out before, in progress and after intervention for communication or other purposes (Intervention report, website, Newsletter …).

ARTICLE 10 – Hypertext links

Hypertext Links established to other sites and from www.muses-et-art.org can in no way engage the responsibility of the Muses & A.R.T. Association.

ARTICLE 11 - Publication by the User in the Comments

The muses-et-art.org site allows Users to post comments.

In their publications, the User is required to respect the rules of the Netiquette as well as the rules of law in force. They are held responsible for any content they put online.

The User undertakes not to publish content that may harm the interests of third parties, such as abusive remarks made against another User or the unauthorized reproduction of content protected by copyright. All legal proceedings initiated by an injured third party against the site must be taken care of by the User.

The User retains all of their intellectual property rights. However, any publication on the site implies the delegation of the non-exclusive and free right to the Publishing Association to represent, reproduce, modify, adapt, distribute and disseminate the publication anywhere and on any medium for the duration of the intellectual property. This can be done directly or through an authorized third party.

The site has the right to exercise moderation on publications and can refuse their posting online without having to provide any justification. The deletion or modification by the site of the User’s content may be carried out at any time, for any reason and without notice.

Article 12 – Jurisdiction and applicable law

These T&Cs are governed, interpreted and applied in accordance with French law.

In the event of a dispute relating to the application, interpretation or termination of these T&Cs, and in the absence of an amicable resolution, only the courts of Lyon have jurisdiction.

ARTICLE 13 – Duration

These T&Cs are applicable for the duration of the online donation service on the association’s website or that of Hello Asso, as well as that of the paper form.
